These Terms of Service (“Terms”) govern your use of radmobilecarts.com and purchases from Rare Aesthetic Designs LLC, doing business as RAD Mobile Carts (“RAD,” “we,” “us,” or “our”). By using the site or placing an order, you agree to these Terms and our Privacy Policy. If you are ordering for a business, you represent that you can bind that business.
These Terms are a plain-language starting point and are not legal advice. Have counsel review the refund, warranty, SMS, liability, and governing-law provisions for your actual business and sales jurisdictions before relying on them.
Products, configurations, and pricing
Our carts are handbuilt and may vary slightly from photographs, drawings, samples, or screen previews. You are responsible for reviewing the selected type, style, top, color, finish, size, equipment, add-ons, branding, and other specifications before submitting an order. Prices are shown in U.S. dollars and may change until an order or quote is accepted. Shipping, local delivery, pickup, and applicable taxes are shown or calculated at checkout. A configuration or inquiry is not a promise that an option is available until RAD confirms it.
Orders, quotes, and payment
Online checkout creates an order after Stripe confirms a successful payment. Manual inquiries and quotes are proposals until accepted and paid according to the document. A deposit or partial payment does not necessarily mean the full project balance is paid; the applicable quote or invoice controls the remaining balance. We may contact you to confirm specifications, address, timing, and availability before production.
Stripe processes payment, customer, invoice, and tax information on our behalf. By completing checkout or paying an invoice, you authorize the amount presented, including shipping and applicable tax. We do not store full card numbers. Receipts, confirmation email, hosted payment pages, and invoice records may be provided electronically.
Custom work, cancellation, returns, and defects
Custom and made-to-order carts are built for the specifications you approve and generally cannot be returned for a change of mind. Review the separate Returns policy for the current rules on cancellations, damage, defects, and any approved remedy. Do not begin a chargeback before contacting us about an issue; that does not remove any rights you may have under applicable law.
If you submit incorrect specifications, measurements, artwork, address, or delivery information, you may be responsible for resulting rework, delay, or additional cost to the extent allowed by law. Any warranty, service commitment, or remedy we provide must be stated in the applicable quote, invoice, written confirmation, or Returns policy.
Production, shipping, pickup, and delivery
Published production windows are estimates, not guaranteed delivery dates. Materials, customization, carrier delays, weather, inspection, supply issues, and events outside our reasonable control may change timing. Shipping, local delivery in the stated service area, and Riverside pickup have different prices and instructions. You are responsible for providing an accurate address, being available for delivery, inspecting a shipment, and following the instructions on our Shipping page. We may use a carrier or RAD delivery and may send tracking or scheduling information by email or an opted-in text.
Order tracking and communications
Our tracking tool requires an order number and matching email address. Keep those details private. Status information is based on the records available to RAD and may lag behind production or carrier events. Service emails may include order details, receipts, build status, delivery information, and links to payment or tracking pages.
Text Messaging (SMS)
RAD operates an optional text messaging program with two independent categories:
- Order updates: confirmations and build, quality-check, shipping, pickup, or delivery updates.
- Marketing: occasional promotions, sales, and new-release announcements.
You enroll by checking the corresponding box at checkout. The boxes are separate and unchecked by default, and SMS consent is not required to purchase. Message frequency varies; message and data rates may apply. Reply STOP to cancel the applicable category, HELP for help, or email radcarts@gmail.com. Carriers are not responsible for delayed or undelivered messages. See the Privacy Policy for how phone numbers and consent records are handled.
Email and newsletter
When you subscribe on the homepage, submit an inquiry, or complete a purchase, we may add your email to the RAD updates list. Marketing email can be stopped through its unsubscribe link or by contacting us. Transactional messages such as order confirmations, receipts, inquiry responses, invoices, and status notices may still be sent when necessary to provide the service.
Third-party services and links
Stripe, Resend, Twilio, Vercel, Google Maps/Places, Google Fonts, carriers, Instagram, and other providers may support the site or your order. Their separate terms and privacy policies may apply to their services. We do not control third-party availability, policies, or content. You may not use the site to submit unlawful, abusive, fraudulent, infringing, or malicious material.
Intellectual property
RAD’s names, logos, designs, drawings, photographs, text, and site content belong to RAD or its licensors. You may view the site for personal or internal business purchasing purposes. You may not copy, sell, modify, scrape, distribute, or use our content or branding commercially without written permission. Customer-supplied artwork and specifications remain the customer’s responsibility, including the right to provide them.
Disclaimers and limitation of liability
To the fullest extent permitted by law, the site and non-written information are provided on an “as available” basis. We do not promise uninterrupted site access, error-free configurator calculations, exact image colors, carrier timing, or guaranteed message delivery. Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded.
To the fullest extent permitted by law, RAD and Rare Aesthetic Designs LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits or business interruption, arising from the site, an order, a delay, or a third-party service. Our total liability for a claim relating to an order will not exceed the amount you paid for the affected order, except where applicable law does not allow that limitation.
Changes, governing law, and contact
We may update these Terms when the site, products, or law changes. The updated date above identifies the current version. To the extent permitted by law, California law governs these Terms without regard to conflict-of-law rules, subject to any mandatory consumer protections that apply where you live.
